Highway Legal Division Manager – Kanawha County
Nature of Work
Responsible for managing and supervising the Employment Section of the Legal Division that encompasses legal issues involving employment matters, including but not limited to work in the area of employment and administrative law: Represents the agency in trials and hearings before various judicial and administrative forums for grievances, unemployment compensation cases, workers compensation cases, Human Rights cases, and EEO cases; conducts depositions; prepares legal documents such as pleadings, briefs, opinions and contracts; and performs similar or related work as required. Provides opinions for disciplinary actions.
Provide legal opinions and recommendations on novel or complex issues to WVDOH and WVDOT organizational units, Division Director and agency management. Perform advanced legal research and writing regarding the same. Providing status to Legal Division Director, and district managers regarding status of employment matters and legal actions taken and position taken by agency. Coordinating assignments and turnaround with agency district managers and personnel. Making suggestions for resolutions to complex employment matters. Meet with appropriate personnel to learn about the various functions at issue in pending legislation and the type of change needed. Research applicable laws and prepare recommended changes for the Commissioner’s consideration and recommendation to the Executive and Legislative branches. Draft new legislation as requested by Division Director or upper-level agency management. Mentoring and training subordinate employees.
May also respond to Freedom of Information requests, document requests disciplinary legal opinion requests, road abandonment issues, outdoor advertising and salvage yard issues and cases, bankruptcy cases, and special projects. Other duties as assigned. Must possess excellent written and oral communication skills and be able to work with and maintain confidential information. The successful applicant must be discreet and tactful in safeguarding sensitive information and be able to work with and maintain confidential information. Valid Driver's License is required and willingness to travel statewide.

Typical Duties and Responsibilities
• Direct, supervise, and lead the Legal Division staff of a specialized legal practice area including attorneys, and administrative support in determining case strategy, developing litigation tactics, research, investigations, and conducting litigation
• Report to the Director of the Legal Division and the Executive Division.
• Responsible for all legal activities of the section including the review of contracts, rendering of legal opinions, and conducting of litigation
• Coordinating work of the section by providing administrative activities associated with making assignments, determining priorities, and monitoring progress
• Rendering legal advice and opinions to their sections’ clients or in the area of legal specialization
• Recommends salary increases, promotions, and other appropriate personnel actions
• Must use independent judgment in the interpretation and adaption of policies and guidelines
• Represents the agency in various administrative and judicial forums
• Performs more complex legal work in connection specialized area of assignment such as contract law, employment law, real property law, collections and civil litigation matters
• Determines further appeal of contested cases
• Analyzes and makes recommendations to the Director and the Executive Division regarding settlements and/or legal strategy
• Consults with agency staff on the interpretation of court opinions and statutes, the application of rules and regulations, and related matters where a serious legal issue is involved
• Collaborates with groups or individuals from outside the Division of Highways in a moderately unstructured setting
• The work involves isolating and defining unknown conditions, resolving critical problems, or developing new theories.
• Performs related duties as assigned
• Travel may be required;therefore, a valid driver’s license may be required
Required Skills and Knowledge
• Knowledge of legislative procedure, bill drafting, and the implementation of legislation
• Knowledge of statutes, court opinions, and Attorney General opinions
• Knowledge of judicial and quasi-judicial procedures
• Ability to conduct complex civil and administrative litigation in trial and appellate courts
• Ability to analyze facts, evidence, and legal instruments
• Ability to interpret and apply laws, constitutional provisions, statutes, administrative regulations, and court decisions
• Ability to establish and maintain effective working relationships with other agencies, other WVDOT/DOH divisions, the public, and the federal government
• Ability to communicate effectively and express conclusions and arguments clearly and logically both orally and in writing
• Ability to supervise and direct the work of subordinate attorneys and other staff members in the conduct of legal affairs and establish and review results
• Ability to effectively coordinate staff functions in the provision of competent legal assistance to the Agency
• Ability to determine issues in various cases
• Ability to analyze complex legal issues and render formal opinions
• Ability to creatively develop case strategy and tactics and have excellent skills in problem solving
• Ability to demonstrate discretion
• Ability to mentor, develop, and train subordinate attorney and administrative staff
Required Education and Experience
REQUIRED EDUCATION
• Admission to practice law in the State of West Virginia

REQUIRED EXPERIENCE
• Seven years of full-time or equivalent part-time paid experience in the practice of law, including one year of trial work, two years of which must have been in a supervisory or lead worker capacity.
• Substitution: One year of full-time or equivalent part-time paid employment as an attorney with the agency assigned shall be considered the equivalent of two years’ experience, excluding the administrative or supervisory requirement.
